Terms of Service
These Terms of Service form a binding agreement between you and TrueTenant Inc. governing your access to and use of our Platform.

1. Introduction
Acceptance of the Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and TrueTenant Inc. ("TrueTenant," "we," "us," or "our"). These Terms govern your access to and use of our website, application, software systems, and related products or services (collectively, the "Platform").
By using the Platform or by selecting "I Agree", you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you are entering into these Terms on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms, in which case "you" refers to that entity.
If you do not agree with these Terms, you must not access or use the Platform.
2. Modifications
We may revise and update these Terms at any time at our discretion. All changes are effective immediately upon posting on the Platform and apply to all use thereafter. Continued use of the Platform constitutes acceptance of the modified Terms. It is your responsibility to review the Terms regularly.
3. The Platform
The Platform allows landlords, property managers, and real estate professionals ("Landlords") to evaluate potential tenants and guarantors ("Tenants") through identity verification, financial and employment validation, credit screening, fraud detection, and related AI-driven analysis.
The Platform integrates third-party data providers and verification systems (including but not limited to credit bureaus, payment processors, data aggregators, and biometric verification services) to deliver risk assessments and screening reports.
Important: TrueTenant provides automated insights and recommendations only. TrueTenant does not make leasing decisions and is not responsible for any outcome resulting from the use of screening data or recommendations.
4. Account Registration and Security
Landlords and property managers must register an account to access the Platform. Tenants and guarantors may access the Platform via a secure invitation link or code provided by a Landlord.
You agree to:
- •Provide accurate, current, and complete information during registration;
- •Maintain the confidentiality of your login credentials;
- •Notify us immediately of any unauthorized use of your account; and
- •Accept full responsibility for all activity under your account.
TrueTenant reserves the right to suspend or terminate any account that violates these Terms or appears to compromise security or integrity.
5. Tenant and Guarantor Information
5.1 Submission of Information
Tenants and guarantors may be required to provide identification, employment, financial, credit, residency, or immigration documents, and may undergo biometric verification ("Applicant Information").
You represent and warrant that all Applicant Information you submit is accurate, complete, and unaltered. Submitting falsified, modified, or fraudulent information may result in immediate suspension and may be reported to authorities or credit bureaus.
5.2 Use of Information
By submitting Applicant Information, you authorize TrueTenant to:
- •Use and disclose such information for identity verification, fraud prevention, screening, and scoring purposes;
- •Share relevant findings and reports with the Landlord(s) or property manager(s) associated with your application; and
- •Retain de-identified data for product improvement, research, and compliance purposes, as permitted by law.
5.3 Third-Party Providers
TrueTenant relies on external providers (e.g., Equifax, Flinks, Plaid, Veriff) to verify information. TrueTenant does not independently verify such data and assumes no responsibility for its accuracy or completeness.
6. AI-Generated Reports and Scoring
TrueTenant's Platform uses AI and algorithmic systems to produce screening outputs such as credit analysis, fraud risk flags, income consistency checks, and overall "fit scores."
These outputs are informational only and do not constitute financial, legal, or housing advice. All final tenant selection decisions are made solely by the Landlord.
TrueTenant disclaims any liability arising from:
- •Reliance on AI-generated results or scoring;
- •Inaccurate or incomplete data inputs; or
- •Any adverse decision or action taken by a Landlord or Tenant based on Platform outputs.
7. Prohibited Conduct
You agree not to:

8. Intellectual Property
All materials on the Platform—including text, software, algorithms, AI models, data, design, and trademarks (including "TrueTenant", the TrueTenant logo, and any related marks)—are owned by TrueTenant Inc. or its licensors.
You may not reproduce, modify, or distribute Platform materials except as expressly authorized. Unauthorized use constitutes infringement and may result in legal action.
9. User Content
Users may upload or submit information ("User Content") to the Platform, including documents, photos, and other data.
By submitting User Content, you grant TrueTenant a worldwide, perpetual, irrevocable, royalty-free license to use, store, reproduce, and share such content as necessary to operate and improve the Platform and as permitted under the Privacy Policy.
You represent and warrant that:
- •You own or have rights to provide the User Content;
- •The User Content is accurate and lawful; and
- •Its submission does not infringe any third-party rights.
10. No Reliance and Third-Party Links
TrueTenant does not guarantee the accuracy, completeness, or reliability of any content, third-party data, or linked external platforms. Any third-party site accessed through the Platform is used at your own risk and subject to that site's terms and policies.
11. Disclaimer of Warranties
The Platform and all related content are provided on an "as is" and "as available" basis.
TrueTenant makes no warranties, express or implied, regarding:
- •The accuracy or reliability of screening results;
- •Continuous or error-free operation;
- •Freedom from viruses or security breaches; or
- •Suitability of outputs for any purpose.
To the maximum extent permitted by law, all implied warranties (merchantability, fitness for purpose, non-infringement) are disclaimed.
12. Limitation of Liability
To the fullest extent permitted by law, TrueTenant, its officers, employees, agents, and affiliates shall not be liable for:
- •Any indirect, incidental, consequential, punitive, or exemplary damages;
- •Loss of profits, goodwill, or data; or
- •Any decision or outcome related to tenant screening or leasing.
If liability cannot be excluded, TrueTenant's aggregate liability shall not exceed CAD $100.00 or the total fees paid to TrueTenant in the twelve months preceding the event giving rise to liability, whichever is greater.
13. Indemnification
You agree to indemnify and hold harmless TrueTenant and its affiliates, directors, officers, employees, and agents from and against any claims, damages, losses, or expenses arising from your:

14. Dispute Resolution
Prior to initiating any legal action, the parties must attempt to resolve disputes in good faith through written notice and a 30-day informal resolution period.
Any unresolved dispute shall be submitted to binding arbitration in Toronto, Ontario, under the Simplified Arbitration Rules of the ADR Institute of Canada, Inc. The parties shall share arbitration costs equally, except as otherwise decided by the arbitrator.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
The parties agree to submit to the exclusive jurisdiction of the courts of Ontario for any matters not subject to arbitration.
